Knowledge of Students of Higher Education Institutions About Hudud Punishment: A Study in UNISSA and KUPU SB

Abstract

Hudud punishment is a punishment prescribed by Allah Subhanahu wa Ta'ala for offenses that are categorized as hudud crimes, namely zina, qadzaf, drinking alcohol (syurb alkhamr), stealing (sariqah), robbery (hirabah), murtad and rebellion (bughat). The Syariah Criminal Penal Code Order, 2013 was declared on 22 October 2013 and came into force on 1 May 2014 and has given rise to various perceptions. This study was conducted to determine the level of knowledge among students of higher education institutions among UNISSA and KUPU SB students about hudud punishment: A study at UNISSA and KUPU SB. IPT students need to be knowledgeable in all fields and knowledge of the hudud punishment in terms of theory, pillars, conditions, punishment and implementation is no exception. IPT students need to be clearly explained on the aspects that involve knowledge of the hudud punishment. This study also discusses the basic elements consisting of the pillars and conditions that must be met to convict offenses categorized as hudud crimes and then the punishment according to the Shari'ah Criminal Penal Code Order, 2013. The research methodology used is quantitative method in addition to using analytical techniques by examining secondary data information especially writings, journals, research papers and articles. The results of the study found that the level knowledge of UNISSA respondents was 44.7% and KUPU SB was 47.2%, the majority were unsure about the principles, conditions and punishments that would be imposed for each offense that is considered a hudud crime.
