Abstract

Guarantee is one of the important personal insurance for the benefit of creditors and debtors, which can provide benefits to debtors to borrow what they need from creditors. As can give credit to creditors because there is someone who will guarantee the debt. In this study, the debater will explain about the guarantees and law in Islamic Fiqh and the Brunei Law. The author will explain the understanding of guarantee, guarantee agreement, guarantee issues, the way of guarantee and guarantee in the Brunei Law. The author will also use the Criminal Procedure Code Chapter 7 and The Islamic Religious Council Act and the Court Judgement Chapter 77 to explain the Brunei Law. The author has followed the steps that have been arranged by collecting quality, quantitative and descriptive information as well as comparisons by reading some books that have referred to some of the books available in the library of Sultan Sharif Ali Islamic University. With this research, it is hoped that it will be able to provide benefits and contributions to people who read this study, students from all levels, students and college students in Brunei Darussalam, especially students of the Sultan Sharif Ali Islamic University. Apart from that, this study can also be used as a reference for those who want to do research on topics related to this study.
