تطبيق وقف العقار وأثاره في اقتصاد المجتمع البروناوي

Abstract

Waqf is one of the sunnah advocated by the Prophet Muhammad SAW and encouraged to be practiced in Islam. In general, waqf practice has become a part of the Muslim community’s life around the globe and likewise in the country of Brunei Darussalam. There is no objection regarding the practice of waqf that has been practiced since the entry of Islam in Brunei Darussalam which is about the middle of the 14th century. Mosques and schools are part of the examples of waqf implementation of real estate that have been implemented in this country and it shows indirectly that the understanding of waqf among the society is very limited into traditional waqf which is non-productive. Through this study, the researcher will explain about the implementation procedure of waqf for real estate in accordance with the rules and laws of Brunei Darussalam which have been outlined according to the Islamic Religious Councils and Kadi Courts Chapter 77 in chapters 97, 98 and 100 and further explanations regarding the effects of the waqf on the economy of Bruneian society. This study uses a quantitative methodology which is by looking at the past studies that have been made, especially journals, research papers and articles. The result of the study found that the impact of the implementation of waqf for real estate on the economy of the community in Brunei is not very prominent and can be said to have not achieved benefit from it. It is hoped that this study will be a guide to some modifications to the administration of real estate endowment in order to increase the benefits from it while keep adhering to the views of Syafi’iyah as much as possible. Therefore, point of views and suggestions that might be necessary will be included at the end of this writing.
