dc.description.abstractIslamic Sharia Law never neglects the wellbeing of humans. In fact, Islamic Sharia law always look at the benefits to mankind and examines the whole aspect of life and has never been idle about the plight of mankind especially in carrying out the main roles of jurisprudence which are to uphold justice, defend the mistreated and grant the right to who is entitled to accept it. We will not achieve this except by using the guidelines set by Islam. With this in mind, the conditions related to be a judge and lawyer must be fulfilled to maintain this mandate. This study compares the conditions set by the country of Brunei and the conditions that has been prescribed by Islam by taking into account numerous number of arguments and discussions of scholars from several schools (mazhab) to better know the process or characteristics that allow a person to be called a judge or a lawyer.en_US
