أحكام الخنثى في الفقه الإسلامي

Abstract

The issue of intersexuality is one of the things that is rarely discussed in the media, debates or seminars either at the national or international level so it is also very limited in accessing reliable reference materials. Therefore, among the objectives of this study is to explain the meaning of khunsa and its types, and the difference between khunsa and mukhannas. In addition, this study will also discuss the laws related to the khunsa in the aspects of worship, marriage, division of inheritance to himself or to others either in the form of rights and obligations by bringing arguments from several sects. Guided by references from the Quran, the hadith of the Prophet Muhammad Salallahu ‘Alaihi Wassalam, the ijtihad of the scholars, fiqh books and the internet. The study concluded that it will be able to assist other studies in studying the acknowledge about khunsa and it is hoped that it can be a guide and taken care of by those who responsible in helping this group towards natural human nature.
