Abstract
It is clear that the Mut’ah marriage is forbidden by the Prophet Muhammad
SAW, but in this age, they do this marriage in some places. The Misyar
marriage meets all the legal requirements of marriage, which are similar to
the presence of the Wali, Syahid, Ijab and Qabul. However, such a
marriage can cause the husband to not fulfil his responsibilities to the wife
as an example of the usefulness of providing his wife with the benefit.
Although the marriage of Misyar is valid from the legal ruling, if the
husband and wife do not perform their responsibilities, it is not ideal for
their marriage because it does not achieve the real purpose of the marriage.
Scholars also do not encourage such marriage because it seems that
adultery is only legalized as a fun marriage. This aims to further expand
the understanding between the differences between these two marriages,
which are overwhelmed by understanding and what its impact on the
family and society is. The research was presented in the introduction and
chapters: the introduction dealt with the basics of the research, i.e., on the
understanding between the differences between the two marriage and the
marriage of the intention of divorce, the first chapter discussed the Mut’ah
marriage: in which the jurisprudence and the effects of its prohibition were
seen. The second chapter discussed the Misyar marriage: it saw the
jurisprudence and the effects on the family and society. Lastly, the
marriage of Mut’ah and Misyar can never have a long lasting and happy
marriage, apart from the marriage that Allah has prescribed.
