Abstract

Every human being who is mature physically and spiritually healthy, definitely needs a life partner. Life partner is the one who can meet the needs and can cooperate in creating a happy family, provide peace and maintain the well-being of married life and adhere to the teachings of Islam. However a marriage is not easy because when a legal bond is forged between a man and a woman to become husband and wife, they will bear and share a great responsibility towards each other. Therefore this research contains some very important responsibilities for husband and wife in law on the implementation of those responsibilities with evidence from the AlQuran and Sunnah. This research also includes effects if there is a refusal on the part of the husband or wife or both to carry out their responsibilities in marriage. The method for producing this research is the analytical descriptive one by reference to the books of jurisprudence, modernism and the books of the Brunei Law for data collection, compilation and analysis in order to achieve the objectives of the research. The research aims to emphasize marital responsibility and its effects on marriage and the family. More importantly, the findings of the research suggest that the commitment of each spouse to their responsibility has the positive effect of ensuring their happiness in their marital life, and strengthening their bond of love with one another. Their failure to comply with this responsibility has the negative consequences of numerous problems, which may lead to separation.
