Abstract
Khalwat is one of many serious offences happen in Brunei Darussalam. The objectives of this dissertation are to give information and to create awareness about type of Khalwat and its law according to Shariah law and Law of Brunei, and therefore to resolve the problems arise related to Khalwat. In addition, this dissertation will focus on the causes of Khalwat, their solutions to this serious offence and the actions taken by the Government in its effort to prevent Khalwat and thus, reduce the number of cases in Brunei Darussalam. Moreover, this dissertation mentions about the negative consequences of Khalwat and the wisdom behind its prevention. This dissertation also includes case studies of Khalwat and information about the whole cases’ procedures. The research will also provide case statistics of Khalwat offences from the year of 2010 to 2016 in all four districts in Brunei Darussalam and the results from survey questionnaires to the public in Brunei Darussalam. The methodology that is used in this dissertation is inductive method of referring to books of Islamic Law, Gazettes of Brunei Government, Brunei’s Book of Law and articles from internet concerned on this issue of Khalwat. To achieve the objectives of this dissertation, an analysis research on public opinions have been collected by distributing questionnaires. In addition, field study of interview sessions with specialists of this crime have been conducted to assess and analyze on this issue. This dissertation is divided into five chapters; first chapter explains the definition of Khalwat and second chapter mentions about the aspects related to the prohibited Khalwat. While in third chapter explains more of punishments committed in crimes of Khalwat, in fourth chapter debates the issues of Khalwat in Brunei and lastly in Chapter Five discusses about the solutions in dealing the issue. Among the results of this dissertation is having a depth knowledge on Khalwat and its laws and understanding the views of people in Brunei on Khalwat and its related issues. In addition, researchers hope that this dissertation study may aid readers in making reference guides.
