Abstract
This research aims to find out more about mut’ah marriage in Islamic perspective. Nikah mut'ah which has been banned by Prophet Muhammad S.A.W. on the day of the opening of Mecca but this type of marriage is rampant and many happen nowadays among students who were studying abroad. This is because members of the Shi'a that allows this type of wedding. The author discusses about the opinion of fuqaha and proposition basis of them against this type of wedding. The author also describes the opinions of scholars of jurisprudence, such as Shi'a and proposition basis of them. The author also describes the effects of this mut'ah marriage on women and children. As for the underlying intent in writing academic exercises is to preserve the dignity of women in the presence of Islam and also preserving their rights. This academic writing exercise is also expected to provide a broad understanding and knowledge inside the field of ahwal syakhsiah. The authors use inductive, analysis methods and comparison methods between a member of the Sunnah Wal Jemaah and Shi'a in order to achieve the purposes of this study. The study was limited in the Islamic perspective only and the author never touches the question of mut'ah marriage in the legislations of Brunei. Therefore, the authors hope that by this academic writing exercise it will be able to explain the actual law of mut'ah marriage and the author also hopes that people will avoid it. The author also explains that mut'ah marriage is haram in Islam and those who say this mut'ah marriage is halal and still doing it, then they have followed the opinion and the practice of members of the Shi'a. Nikah Mut'ah is haram because our Prophet Muhammad Sallallahu Alaihi Wassalam (S.A.W.) was prohibiting this mut'ah marriage on the day of the opening of Mecca.
