Abstract
This research is regarding a theoretical and practical framework on Saddu dhara’ih which entails its application in the Islamic jurisprudences in addition to its modern practice in some countries in the world. It also attempts to provide answers to the main important questions related to the meaning of saddu dhara’ih in the Arabic language context as well as definition in general context alongside with its meaning in Islamic jurisprudence principles and how Saddu dhara’ih is related to the basis of Islamic jurisprudence. This study also states the difference aspect between the schools without skipping through its impact on understanding Islamic jurisprudences, all these questions possess the main focus of this research whereby the researcher provides answers to them. The use of library materials and field study are implemented respectively in line with its application through the use of texts and information that are completely examined through descriptive and analytical research method purposely for the fulfillment of the topic. At the end of this research, the most important outcome came across stipulates that Saddu dhara’ih “A deliberate prevention of a permissible act” will not be prevented from unless it leads to dislike or forbidden, and that the Islamic jurisprudences accomplished it but only ways of implementation are different. Among the Islamic scholars who extensively utilize it and there are others who slightly use it. In addition to the extent that the contemporary Islamic scholars imitate the footsteps of the ancient Islamic scholars in its application in the modern practice in various aspects like limiting number of pilgrims in each country, looking the proposed wife through the internet, engaging in trading of shares with forward and future dealing and surgery for beautifulness (plastic surgery or cosmetic surgery) which doesn’t possess stipulated Islamic rules whereby extensive consideration may influence what is permissible to be done, and for this reason certain conditions and procedures have to be considered for it to be used Every aspect is mentioned in its prescribed chapter and explained clearly in this research.
