Abstract

This research aims to explain to people more about implementation of ‘Urf in Brunei court. This thesis consist five section. The first section is divided into four divisions which is the first division about the meaning of ‘Urf, the second division about relationship of ‘Urf with traditions, the third division about the meaning of ‘Ijmak and the fourth division about difference between ‘Urf, traditions dan ‘Ijmak. The second section is divided into two division, the first division about section of ‘Urf and the second division about authentic of ‘Urf. The third section is divided into two division, the first division contains requirement of ‘Urf and the second division contains the importance of ‘Urf. The fourth section is divided into two division, the first division is about implementation fiqhiyah of ‘Urf and the second division is about method fiqhiyah of ‘Urf. The fifth section is divided into two division, the first division contain the importance of ‘Urf in Brunei Darussalam and the second division contain some implementation of ‘Urf and Maslahah in family matters in Brunei Darussalam. Finally, the conclusion. In Sha Allah, this research can help people to know more about implementation of ‘Urf in Brunei court.
