The research aims to highlight the Maqasid side through a fundamentalist study that shows the extent of the Muharram’s actions to others and the Muharram for itself and the extent to which the pretexts may be opened in some cases that surround the need and which the Fatwa people estimate. The research has been divided into two chapters: The first chapter: It includes an original study in three requirements. And the second chapter: It includes an applied study in three contemporary financial applications. The research concluded that the considered need has an effect on the action of the forbidden to others and the forbidden for himself in contemporary financial transactions, which are estimated by the people of the fatwa, and the method followed by the researcher in this research is to refer to the Holy Qur’an and the Sunnah of the Prophet, and several jurisprudential books and books that are related to Library and the Internet.en_US
