Abstract

This research is a comparative study on the crime of theft between Shari'ah and criminal law in Brunei Darussalam. It is a library research, in which the data is collected from written references with few interviews. The first chapter is an overview of the history and development of law in Brunei Darussalam, legal system in Brunei Darussalam, and the philosophy of punishment in Shari'ah and Bruneian law. The second chapter is an analysis of the meaning of and legal rulings of theft in Islamic law. The third chapter is about the crime of theft in Brunei criminal law. The last chapter is a comparison between Shari'ah and criminal law in Brunei Darussalam. The study concludes that the criminal law is not in conformity with Shari'ah, thus it needs to be reviewed.
