This research is mainly aimed to explain the definition of abortion, the reasons it is considered as a crime, in addition to clarify its elements and conditions as well as the consequent judicial punishments in Islamic Law. Abortion is deliberate, unjustified termination of pregnancy before the natural time of birth. Abortion is prohibited in Islam because it violates the laws and orders of Allah and against the right of the fetus to live ; threat to the mother’s life and an offense on communities and societies. The Islamic Criminal Legislation provides punishments on those who commit this crime including Al – Gurrah and Atonement (Kaffarah).
