Abstract

This research consists of the importance of the comparison between the scholars about the lost and found items. It is a common thing that the lost item to be found by others and not knowing who the owners are, this can happen everywhere such at the public area, shopping mall, parking areas, mosques, restrooms and etc. Various reaction can be seen when dealing with this situation, some will took the item and give it directly to the police or to the certain people and some will just left the items where it is initially found. Some will also take the item to own it or to give it away to others. To preserve the human rights of their belongings or the rights to own something in Islamic way, this research was conducted to ensure that the human belongings are preserve by delivering a knowledge to the people and letting them know the rights and obligations taught in Islam to preserve other’s belonging before owning them. Other than that this study aims to give the awareness and to prevent the people from owning the found item before trying to give it back to the owner. To achieve the aims and objectives of this study, the researcher use the library research by looking at the fiqh turath books and contemporary books mention these particular matters, besides the information from the internet resources. As finding, researcher found few important matters; firstly: The need to create a committee in every building specificly to handle the lost and found item, so that the owner can easily search their items. Secondly: There are few guidelines for the people to know their rights and obligation needed in handling the found items.
