Abstract
This research aims to lead the Bruneian people to an understanding of the maintenance of the working wives in Fiqh Islam and Brunei Law. The researcher has chosen this title as it reminds the husband of the importance of fulfilling his obligation to provide maintenance for his wife and other family members. The purposes of this research are to elaborate the meaning of mainteance for wives specifically among the working wives that has been determined by the laws of Islamic Fiqh, and to give some knowledge of the provisions that relating to the maintenance under the Islamic Family Law Act, section 217 (2012). Researchers also use induction methods of information and laws related to maintenance of the working wives from previous Fiqh books, recent research studies and the Internet. Researchers also discuss the obligations of a wife, the law for a working wife, the terms, principles and procedures of a wife to demand a ‘nafkah’ (maintenance) from her husband in the Brunei Court. As a result of this research, it is hoped that husbands will understand their responsibilities, and help the wives find ways to claim the overdue maintenance during their marriage day’s or during eddah period. The researcher hopes this research will help to solve problems relating to the obligations of ‘nafkah’ for working wives.
