Abstract
The aim of this researches is to recognize Hibbah from the Islamic perspective and the Law of Brunei Darussalam. This section consists of three main chapters that are preceded by an introduction and conclude with an ending. The introduction contains the purpose of selecting this topic. The first chapter discusses the meaning of Hibbah (giving), and its differences with alms and gifts. In this chapter there are also references to gifts from the Quran, Sunnah and Ijmak. In the second chapter, we discuss fuqaha's views on the principles of Hibbah and their terms. It also contains the law of Hibbah and justice in its distribution or equality in giving. The last chapter, the third chapter, is about Hibbah in the Law of Brunei Darussalam, in terms of its meaning, terms and conditions. The research method for this discussion is to refer to Islamic sources, the Qur'an and the Sunnah, and then the library study to refer to the fiqh books available at the Sultan Al-Sharif Ali Islamic University library in this regard, whether from the Arabic books or Malay books. It also refers to the electronic information network (Internet). And in terms of the law, refer to the Constitution of Brunei Darussalam, on the Chapter of Hibbah. The result of this study is to understand the meaning of the Hibbah and also to distinguish its precepts, its terms and the laws regarding the Hibbah in terms of Islamic Fiqh and Brunei Law. And also to know the reversal and justice of the equitable distribution of the gifts.
