Abstract
This research is about the maintenance of working wife and its effects in Islamic Fiqh and the Law of Brunei. The main reason for choosing this topic is because of the husband's negligence in providing maintenance for a working wife in this age of modernization, in which many wives having a high level of career in their jobs and earn a high income of money and capable to cope with their life and provide for their families. This research contains three chapters, in which the first chapter discusses on the concept of maintenance in Islamic jurisprudence. Meanwhile, the second chapter explains about the maintenance of a working wife and its impact on Islamic Fiqh and the last chapter debates on the position of wife's maintenance in Brunei's legislation and its effect. The study was conducted through inductive and research methods from the Fiqh books and the Emergency Order, Islamic Family Law Act, Chapter 217, in which there are descriptions on the application for the maintenance of wife as stipulated in the Law of Brunei and also from the case which relates to the calamity of wife’s maintenance. Statistical studies from the year 2014 until 2016 show that maintenance is among the highest of complaints against marital hold problems in Brunei Darussalam, obtained from the Family Advisory Service Division, Ministry of Religious Affairs of Brunei Darussalam. The overall outcome from this thesis is to create awareness towards husbands on their responsibilities towards their wives although they have carriers. The main recommendation here is to increase awareness as well as to give exposure towards the society on the importance of providing maintenance of a working wife
