Abstract

It is common, that conflicts are existing in a marriage. However, a serious conflict or dispute may result in the destruction of marital harmony, which led to a divorce. Meanwhile, marital life must be protected in any circumstances. This study, entitled "Divorce between spouses due to conflict (syiqaq) in Islamic Fiqh and Islamic Family Law Brunei". This study explores and compares the opinion of the venerated scholars on the cause of the conflict (syiqaq), ruling, consequences and its solutions based on the teachings of Islam and the provisions of Islamic Family Law of Brunei, 1999. This study consists of four parts, the first part consists of an introduction, part two deals with the Divorce between spouses due to conflict (syiqaq), the third part explaining on how to resolve disputes according to the Islamic teaching and the final part quotes about divorce between spouses due to conflict (syiqaq) in Islamic Family Law Brunei, 1999 and implementation of arbitration under chapter 43.
