Abstract

In this contemporary world found a contemporary medical process aimed at protecting the soul (hifdz al-nafs) and protecting offspring (hifdz al-nasl); that contemporary medical process required accuracy of understanding by making many researches regarding the matter of abortion to know the law and the elements in it so people are not trapped in suspected and haram. One of these contemporary medical processes is abortion which is a difficult decision for a pregnant woman. Therefore, the researcher tries to explain about abortion in the perspective of Islamic jurisprudence (four madzhab) and medical sciences. Besides that, the researcher also tries to explains the similarities and differences between them. In this research, the researcher uses the theory of inductive approach and collects the empirical data from various sources such as Fiqh and Fiqh literatures, as well as document and previous researches. The researcher also conduct interviews and surveys aiming the midwifes to gain knowledge and explanation about abortion in the perspective of medical sciences. Afterwards, the researcher analyzes the collected data using descriptive analysis method and arranges them in sub-sections and some points. The most valuable analysis outcome achieved by the researcher in this research is that both of Islamic jurisprudence and medical sciences has agree on most of abortion laws except in a law that is about defective fetal abortion before the soul blows. The researcher hopes that this research will be useful for herself and the readers in general. She also hopes that this will be useful for all moslems in the knowledge of abortion in the perspective of Islamic jurisprudence and medical sciences by knowing the similarities and differences between them.
