الكسب الحرام وأثره في الفقه الإسلامي: دراسة فقهية مقارنة

Abstract

After observing that humans are in need of both employment and a steady income to maintain their way of life, the religion of Islam has encouraged its people to earn an income legally and to avoid obtaining illicit income. People tend to be busy that they forget and ignore that they got their money gains through illegal and wrong means. Therefore, the researcher has made a decision to do a research on this topic, “Illicit income and its impact on Islamic Jurisprudence: A comparison study. To complete this research, the researcher has worked on collecting information from the major books of the earlier and later scholars that relate to this topic. This research contains three chapters; the first chapter is the familiarization of illicit income and its components and the introduction to the meaning of property since property and income is connected in this subject. The second chapter is looking to various ways of illicit incomes, such as illicit incomes through buying and selling, renting, abuse of power, causing damage to the community, seizing the properties of others, inheritance and possession before Islam. Finally in chapter three, how to repent from illicit income is looked at. This research has come to an important result that illicit income has a large impact not only to its doer through his intentions and deeds, which will make him live without blessings from God but its impact has resulted in difficulty to differentiate between both the legal and illegal incomes thus affecting the economy of the country due to the widespread of illicit income.
