| Abstract: | This research would focus on “Arbitration between spouse according to Islamic Jurisprudence and Islamic Family Law Of Brunei 1999”. Arbitration is such a very important in spouse life (husband wife) during a dispute and conflict. It is also one way to save or improve their relationship. The methodology of this Research refers to the books of Islamic Fiqh and Islamic Family Law Of Brunei 1999. The first chapter contained definition and meaning of Arbitration in detail. While chapter two would be focused about the differences of Arbitration with other such as with judgement, conciliation, supervision (Hisbah) and representation. Chapter three will be contained the things that should have Arbitrators (Hakam), the powers given to him, and the conditions set for Arbitrators. The final chapter will be explained in more detail of Arbitration between spouse (husband wife) according to Islamic Law& Family Law Of Brunei. The Research also supports by interviews with some Officers of The Syariah Court Of Brunei Darussalam to help further the success of this Research. Allah The Almighty knows best. |
