Abstract

This thesis about the Financial Rights which is related to Talaq: The Comparison between The Islamic Jurisprudence which is associated with Brunei Islamic Family Law 1999. It consists of three aspects: the financial rights which are caused by Talaq, the financial rights which is mentioned in the Brunei Islamic Family Law 1999 and the difference of it with the Islamic Studies. In the introduction of my thesis, I have elaborated what rights and financial rights meant. Then definition of financial rights which is associated with Talaq that is mentioned in the Islamic Jurisprudence books that consist of its definition, the compulsory needs as well as the needs to be given to a divorcee or a divorce. I also illustrated sections which are related with the rights which are mentioned in the Brunei Islamic Family Law 1999, together with the procedures in association with the financial rights that is mentioned and practiced in the Brunei Syariah Court. Cases were brought forward in association to financial rights. Finally, I also made its difference with those that were mentioned in the Islamic Jurisprudence.
