نكاح الزانية في الفقه الإسلامي: دراسة مقارنة

Abstract

In the sophisticated and modern world, a lot of pregnancy cases occur outside marriage due to the decline of moral behavior. In order to cover the mistake they get married and live in a halal life. From here, the question arises about hukum of marriage pregnant adulterers and the status of their illegitimate children. Therefore, this research is aimed to discuss and explain the answer to the questions above according to Mazhab-Mazhab view. This research divided into two parts. In the first part, the researcher will discuss the meaning of marriage and adultery in Islamic Jurisprudence. While in the second part, the researcher will discuss the issue about the hukum of adulterer marriage from the view of Imam- Imam Mazhab Fiqhiah and the status of the illegitimate child. This research aimed to determine that questions concerning the issue of adulterer marriage. This is because people nowadays remains confused about the hukum of marrying the adulterer, especially regarding adulterer pregnant. Due to this reason, it is important to discuss and explore deeply about these issues. The most important result of this research will be different opinions for the hukum of adulterer’s marriage and the status of the illegitimate child.
