العنف ضد الأطفال في الفقه الإسلامي والقانون البروناوي

Abstract

Children are the most precious and valuable gift from ALLAH S.W.T to every parents. They are heir and life of the family. However, nowadays as we can hear and see, many cases of child abuse occurs among us. This child has suffered physically, mentally and spiritually ill from the violence. This study will focus on the problems of violence against children in the perspective of Syari’ah and the Law of Brunei Darussalam. Naturally human love peaceful and prosperous, that’s why I choose this title, in order to see and help people to live peacefully and lovely. I hope this study will help the community to solve this matter and give justice to the victims by punish the abusers according to the Law of Brunei Darussalam. This study consists of three clauses. The first clause will explains the meaning of the child from the perspective of Syari’ah and law of Brunei Darussalam, explaining the rights of children and the roles and responsibilities of parents towards their children. Meanwhile the second clause will explains the types of violence against children, the reasons and the consequences of such violence. While the last clause will explains how to educate children according to Syar’iah, to explain the proper methods, and also solutions how to reduce this problem in terms of Syari'ah and the laws of Brunei Darussalam. I hope with this study and research will develop the capacity of knowledge of the crime on children and punishable by the Syari’ah and the Laws of Brunei Darussalam. I also hope that this study will provide useful information to students, especially to students of Syari’ah and Judiciary.
