Abstract
Harmony in the family is the goal of a marriage covenant. This goal is not achieved if the rights and duties of each other are not fulfilled. Generally, Indonesian migrant workers (PMI) working in Brunei Darussalam remain in the country without their spouses due to immigration regulations and policies. This situation has affected the institutional harmony of the family of Indonesian workers in Brunei Darussalam, as many rights and responsibilities between spouses have been neglected. The purpose of this study is to explain the rights of Indonesian workers in Brunei Darussalam without spouses under Islamic law. The study also aims to investigate the family problems they face while living in Brunei Darussalam without a spouse. The method used in this study is a qualitative and quantitative method that combines library and field research. The study found that Indonesian workers in Brunei Darussalam face various problems such as overstaying, unpaid wages, work not agreed upon, and others. Family problems they face because they are living without a partner or separated from their legal partner include: Cheating with the partner, adultery, divorce and polygamy without the consent of the wife. There are other jurisdictional issues as well, including: Indonesian working couples cannot file for divorce until it is determined whether they are alive or dead, or if they are serving a prison sentence or are in a state of infirmity. In general, Indonesian workers living without their legal spouse in Brunei Darussalam affect family harmony and work efficiency.
